Welcome to Wristshot AI (the “Service”), operated by Kairos AI (referred to as "we," "us," or "the Company"). By accessing or using our website at [wristshot.ai] (“Website”), you agree to these Terms of Service (“ToS”). If you do not agree, please do not use the Service.
2. Description of Service
Wristshot AI provides an online platform where you can upload a wrist photo and a watch photo to generate a photorealistic image of that watch on your wrist. Pro users may also generate short videos from images.
3. User Obligations
- You represent and warrant that you own or have the rights to any photo you upload and that it does not infringe any third-party rights.
- You agree not to upload unlawful, offensive, discriminatory, unethical, or infringing content.
- You must create an account and provide a valid email address to access your results and manage your credit balance. Failure to provide a correct email address may prevent access to your generated content.
4. Payments and Refunds
- The Service operates on a credit-based model. One image generation consumes 1 credit. Video generation (Pro only) consumes 20 credits.
- Credits are sold in one-time packs via Stripe Checkout. Credits are non-transferable and have no cash value.
- If a paid generation fails due to a system error and no result is delivered, we may restore the consumed credit automatically.
- Refunds for credit pack purchases are handled via Stripe per applicable policies. As image and video generation tasks incur costs, you may not ask for a refund if you have already spent credits.
5. Intellectual Property
- All rights in the Service and Website content are owned by the Company.
- You retain ownership of your uploaded photos. By uploading, you grant us a temporary, non-exclusive license to process them solely to provide the Service.
- Subject to third-party rights and applicable law, you own the outputs (generated images and videos) created for you. Free-tier images may include a small "Generated by Wristshot AI" watermark.
6. Disclaimer of Warranties
The Service is provided "as is." We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement.
User-Generated Content: You are solely responsible for the content of images and videos generated using our Service. We do not monitor, review, or endorse user-generated content and assume no responsibility for any harm, legal issues, or consequences arising from such content.
7. Limitation of Liability
To the maximum extent permitted by law, the Company's total liability for any claim arising from these ToS or the Service shall not exceed the total fees you have paid in the preceding twelve months.
8. Indemnification
You agree to indemnify and hold harmless the Company, its officers, and affiliates from any claims arising out of your use of the Service or violation of these ToS.
9. Governing Law and Jurisdiction
These ToS are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the courts of Paris, France.
10. Changes to These Terms
We may update these ToS at any time. We will post the revised date at the top and notify you via the Website. Continued use after changes constitutes acceptance.
